Pretend for a moment Obama is not the President. Pretend it is a Republican.
Checks and Balances. If the Legislative Branch believes that the Executive Branch has overstepped its reach and is violating the Constitution, what course of action should be taken? That's what the Judicial Branch is for, to decide these matters. Offline

Legislative gridlock and politicking is generally why the Executive branch has power creeped in addition to numerous 'military engagements' that can't wait for Congress to make up its mind.
Much of Congress rather the heavy lifting be done by the POTUS so they can then claim they had nothing to do with it. Party affiliation means nothing. Win/win for pols. Remember that Iraq vote?
