Depends on the GM. I know right now they are typically a lazy bunch, but a few years ago, some GMs took it seriously, some didn't. We had one guy lot and not pay, and the GM did nothing to the person, because "You can't technically sell an item you don't have in your possession.", then later, we had another GM not only take the item from the person, but also the agreed upon amount of Gil, and pay our leader with it.
No, you're mistaking 3 different situations ans just treat it as "GMs are lazy and do whatever they want".
There are strict policies.
If the agreement is bad, nothing will be done as the GM cannot prove that there was a proper agreement, and therefore cannot prove the scam.
If the agreement is good, the player who's guilty will be dealt with.
If it was a trade based scam and the item is still on the guilty player, it can then be given back (money, items in general). However, there are absolutely no guarantee of this, ever. The GM will always tell you "we will do our best, but we cannot guarantee anything". There are many factors, many things to check with the policy, before you can move items, or even create them if the situation requires it. The only thing a GM can be lazy about is not doing the investigation properly/at all, but it's a grave mistake and is very rare.
If you were scammed of a rare/ex item like the example given above, it has never entered your inventory, so you aren't allowed to have it being given to you.
If you were trade scammed and the item has been sold/traded to other players, then the investigation becomes much more difficult, as in, it becomes much more difficult to give it back to the player.
If it was sold on AH or through bazaar, you are ***.
GMs may be lazy, just like any human being doing a repetitive work task and dealing with (mostly) idiots, but they still follow specific policies.
Brainless bashing like you do is specifically why players are very difficult to take seriously and are very often told to kindly go *** themselves. In a corporate way and if policies allow, obviously.
Most GMs are pretty enthusiast about the job and aren't allowed to be lazy anyway, they can even be pretty pro active. It's not correct to straight dismiss them.
Just like it takes 2/5min to understand if a player is stupid or not when receiving a call, take the time to understand the policies behind in order to be sure if there is laziness or if it's just policies being harsh.
