As I dive deeper and deeper into the legal complexities of the right to photograph and record in public (I can quote Glik v Cuniffe so fast I will make your head spin), I have noticed a disturbing trend:

The reasons and excuses offered by police officers, firefighters, security officers, even teachers and principals, to keep you from taking a photograph are just plain pathetic.

My favorite is "you don't need to record this, I'm already recording it".

There's also the typical "wire-tapping" statutes cops like to threaten with, which have been applied to all manner of audio recording.

As long as you are not obstructing justice you can film anything happening in a public area, there is no reasonable expectation to privacy.

That's pretty much the bottom line.

That's not to say there won't be consequences from *** who want to stop you from doing so, so you might have to fight for your rights there, but you do have them.

The crime scene thing is true. If there are cones or tape, you aren't supposed to cross them. You're becoming a danger to us or even putting yourself in danger by doing so. If it is an active crime scene then you are potentially contaminating evidence. The commanding officer of the incident makes the scene as big as he wishes it to be, and can expand it as need be.

I'm not 100% for rules on the police side, but for the fire/EMS side of things if you cross our cones you can be fined with "Failure to yield to an emergency vehicle" or "Impeding emergency operations." Both of which are basically a tax on stupidity.

If we are on a fire or a car wreck or something you are putting your own life, and possible our lives, at risk.

I just want to say that yeah, while cops give a lot of bogus excuses, recording an accident or a tragedy so you can be a youtube star for 30 seconds is pretty tactless.

Another 9/11? There would be people climbing over rubble filming it.

You should, you don't have to, respect people's privacy.

That, and the youtube idiots would totally disregard national security for a few Likes though true incidents where national security are a concern never really happen.

That's actually a pretty good idea. A website that you can upload video you take of police acting good or bad. Policing the police is not a bad thing and would benefit everyone. Need one for politicians as well.

Sorry, politicians should be forced to wear full audio video body cameras that upload in real time. They should have NO privacy.

I know that knowledge is power, and I greatly appreciate this knowledge being shared and distributed here today. However, I have one challenge and obstacle to this. Its called "MERICA *** YEAH" syndrome. Unfortunately in this country we have this type of "Species" of people and police that love to assert the highest level of ruthless physical force (to the degree of killing). They are so ruthless and arrogant that they think they can get away with it too. Although some have been in trouble and some haven't as a consequence. You still see it on the news often of those cops that pulled out their guns or asserted some heavy physical and fatal force thinking they are "Judge Dredds" of the law.

As great as this knowledge above is or anything that counters them, how do we deal with this species? They are not afraid of the true law, they take steroids and gleefully practice this kind of HELP I AM TRAPPED IN 2006 PLEASE SEND A TIME MACHINE masculine aggression and take absolute pride in it in their break-rooms as they laugh and fart their steroid-filled experiences away among themselves. What if you are the next victim of this type of common police brutality practice in our precious "MERICA-***-YEAH"?

My solution: We all learn the high velocity fighting techniques through the way of the Bushido, and conceal our blades just incase. With a strike faster than they can think (which isn't very fast), they wont live long enough to question your knowledge of the law.... :P

Either way this is great knowledge. Thanks. Don't be afraid to risk your life while expressing this. This is the only way to defeat them.

Also:
1) Guy shoves cop and reaches for cop's gun.
2) Someone sees something is happening and starts recording.
3) Cop slams guy to the ground and puts his knee on his neck.
4) Everyone watching the video only sees the cop grab this guy 'totally at random' and abuse him for no reason.

Good point, except for.. Why did the Cop allow said "guy" so close to him? Then, exercise excessive force?
Also, with the mindset you put forward with your list. Do you believe citizens should not be able to video the people that are paid to protect them?

Those don't' apply when there is no reasonable expectation of privacy. A public street has no reasonable expectation of privacy and thus anything can be recorded there. Police won't mention any of this and will use all sorts of *** to try to convince you to stop recording voluntarily. If they physical take your phone try to hurt you, then things get really interesting as a good lawyer can use that to destroy them in court.

This is why everyone should have a black box for their vehicle. It should record everything happening around the vehicle along with audio of both outside and inside. This way, when you pull out your phone to start recording, any interference from the police is caught on the car's black box system that they haven't even thought to check. Later, when ***gets real, you hand the car's black box data over to your lawyer and let them barbecue everyone involved.

Opposite as in the police recordings? You absolutely can't trust those. There is too great a chance the police officer will simply have them "turned off" during the supposed incident or that they will simply never materialize in the ensuing trial. Everybody's best bet is to take their own measures for legal defense as the police are not for public safety or keeping the peace. Police Officers are now nothing more then a big gang with the DA's being the gang boss's.

Don't know about others but I'm specifically speaking to police incidents, not crime or accident scenes.

Yeah, you can't enter a taped off crime scene without consequences.

There are certainly YouTube *** out there who would film their mother getting raped if it would get them internet popularity. People who would refuse to help a drowning man for the purpose of filming it instead.

Those people are *** scum.

But that's not what we're talking about at all.

We're talking about situations in which it would be both dangerous to you and illegal to engage yourself such as an officer striking, aiming a weapon, or shooting at someone.

In fairness, if an officer is firing at someone I can see being too shocked or pumped full of adrenaline to want to or even be able to capture the image in some fashion.

But if the officer is acting legitimately within the prescribed boundaries of his power, you're actually documenting appropriate behavior. And if he isn't, you're exercising your civil liberties to call out someone abusing power. Or if you see a crime being committed in a public area, you are indeed legally within your rights to film it and turn it over as evidence to authorities.

No. It's not the safest thing for you to do, or the most comfortable, and I don't necessarily blame someone who doesn't want to inject themselves into that situation and bring stress or danger onto themselves.

Mr. Zapruder is still a household name, for ***'s sake.

But you are allowed to and -- and this is only my opinion -- in some cases ethically compelled to do so. I admit that my opinion on this, however, could be the journalism degree talking. *** thing is useless in actual journalism these days, as true journalism is dead as Dillinger.
